Theft Crimes in Florida

While there are exceptions, in most cases the cumulative dollar amount of the property allegedly taken determines whether theft is classified as a misdemeanor or a felony by the respective state attorney’s offices. Petit theft is charged when the value is less than $300, and grand theft is charged when the cumulative value of the property is $300 or greater. In this regard, Florida law makes no real distinction between the act of stealing property or being in possession of stolen property. For example, stealing a car or being in possession of that same stolen car, regardless of whether you are also accused of stealing it, carry the same penalties. Additionally, your intent to eventually return stolen property is inconsequential. Theft means to permanently or temporarily deprive one of the use of one’s property. The burden of proof remains with the police and the prosecuting attorney on the case. Criminal defense attorney Michael Salazar represents clients who have been accused of:

  • Petit Theft

  • Possession of Stolen Property
